Terms of Service

1. Acceptance of Terms

By accessing or using Pocketise ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Pocketise provides a SaaS platform enabling businesses to create, distribute, and manage Apple Wallet and Google Wallet digital loyalty cards, gift cards, event tickets, and related programs.

3. Account Responsibilities

• You must provide accurate account information and keep it updated.
• You are responsible for all activity under your account.
• You must not share account credentials with unauthorised parties.
• You must be at least 18 years old and authorised to act on behalf of any business you represent.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Send spam or unsolicited push notifications
• Collect data from individuals without proper consent
• Impersonate another person or business
• Attempt to reverse engineer or gain unauthorised access to the platform
• Distribute malware or engage in any harmful activity

5. Subscriptions and Billing

Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable unless required by law. We reserve the right to change pricing with 30 days notice. Failure to pay may result in service suspension.

6. Plan Limits

Each plan has usage limits (cards, subscribers, API calls, etc.). Exceeding limits may result in throttling or prompts to upgrade. We will provide reasonable notice before hard enforcement.

7. Data Ownership

You retain ownership of all data you upload or generate through the Service. We process your data as a processor according to our Privacy Policy. You grant us a limited licence to process your data to provide the Service.

8. Intellectual Property

Pocketise and its technology are owned by us. You retain rights to your brand assets and content. You may not copy, modify, or distribute our platform without written permission.

9. Warranty Disclaimer

The Service is provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free service. Apple Wallet and Google Wallet availability depends on third-party platforms.

10. Limitation of Liability

To the maximum extent permitted by law, our liability is limited to the fees you paid in the 3 months before the claim arose. We are not liable for indirect, consequential, or incidental damages.

11. Termination

You may cancel your account at any time from the billing page. We may suspend or terminate accounts that violate these Terms. Upon termination, your data will be retained for 90 days then deleted.

12. Changes to Terms

We may update these Terms with 30 days notice. Continued use of the Service after the effective date constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of the jurisdiction where Pocketise is incorporated, without regard to conflict-of-law provisions.
